Terms of Service

These Terms of Service govern your use of StayMate. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.

The service

StayMate is an AI guest-concierge tool that answers guest questions using the property facts a host provides. It is an information and convenience tool only. It is not an emergency service and must not be relied on for emergencies — in an emergency, contact local emergency services directly.

Acceptable use

You agree to use StayMate lawfully and not to misuse it — including no attempts to disrupt or reverse-engineer the service, no uploading of unlawful or infringing content, and no use that violates the rights of guests or third parties.

Host responsibility

You are responsible for the accuracy and completeness of the property information you enter. The concierge answers from the facts you provide, so out-of-date or incorrect details may lead to incorrect answers. Keeping your property data current is your responsibility.

Your guests

You are responsible for your relationship with your guests. Where your local law requires, you must inform your guests that the concierge is AI-powered and that their questions are processed to answer them, and obtain any consent or provide any notice the law requires. StayMate handles guest information as described in our Privacy Policy and does not use it to market on your behalf. StayMate does not currently contact your guests directly for its own purposes. It may offer optional features that involve contacting a guest — such as delivering a property’s concierge link at a host’s request, or a separate opt-in program of communications from StayMate — but any such feature is off by default, subject to its own consent, and would operate only where and when it is enabled, as described in our Privacy Policy.

Guest add-on payments (optional)

You may list optional paid add-ons for your guests (for example a late check-out or a mid-stay clean). When a guest asks for one, StayMate records the request and notifies you, and you confirm or decline it — there is no charge at that step. If, and only if, you enable add-on payments and payment processing is active for your account, StayMate may generate a payment link (processed by Stripe) that you share with your guest so they can pay for the add-on. StayMate is not the seller of the add-on: the arrangement, fulfilment, pricing, taxes, cancellations, and refunds for any add-on are between you and your guest, and you are responsible for them. This feature is off by default and operates only where and when it is enabled. Guest payment information is handled by Stripe as described in our Privacy Policy.

Billing and trial

The price and trial length for your property are shown at signup and at checkout, and that is the rate that applies to your subscription. Pricing and trial length may vary over time and by promotion. If we change the price for an existing subscription, you will receive at least 30 days' advance notice by email before the new rate takes effect, and you may cancel any time before it applies. Subscriptions renew monthly until cancelled. Fees are billed per active property.

Cancellation

You may cancel a property’s subscription at any time from your billing settings. Cancellation stops future renewals; access continues through the end of the current paid period.

Recommendations and affiliate links

To help guests, the concierge may suggest local businesses, services, and experiences. These suggestions can include recommendations the host provides and recommendations from StayMate’s own partners. Some links are affiliate or referral links, and StayMate may earn a commission when a guest books or purchases through them, at no extra cost to the guest. A recommendation is not an endorsement, and StayMate is not responsible for third-party businesses or their offerings — confirm details such as pricing, hours, and availability directly with the provider. StayMate may add, change, or prioritize partner recommendations at its discretion.

StayMate may also choose to share a portion of any affiliate or referral commission it earns with hosts. Any such revenue-share would be optional, may vary by program and over time, and is not currently in effect; if StayMate introduces one, the terms that apply will be made available to hosts beforehand. Commissions a host earns through the host’s own links remain the host’s.

To suggest places near you, the concierge may use your approximate location — derived from your device’s network (IP address) or, only if you allow it, your device’s location (GPS). This is used to find nearby places at the time you ask and is not used to track you.

Disclaimers and limitation of liability

The service is provided “as is” without warranties of any kind. AI-generated answers may contain errors and should not be treated as professional, legal, or safety advice. To the maximum extent permitted by law, StayMate is not liable for any indirect, incidental, or consequential damages arising from your use of the service.

Nothing in these terms excludes or limits any right or remedy you may have under applicable consumer-protection law — including Québec’s Consumer Protection Act — that cannot be excluded or limited by agreement.

Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law rules — except where the mandatory consumer-protection laws of your province of residence require that the laws of that province apply (which happens automatically for consumers in Québec and certain other provinces). If you are a consumer, you keep the benefit of any mandatory protections of the law of your place of residence.

Changes to these terms

We may update these terms from time to time. We will post the updated version here and revise the “last updated” date shown above. Your continued use of the service after a change takes effect means you accept the updated terms.
